These Terms of Service ("Terms") form a binding agreement between you and travai ("travai", "we", "us" or "our") and govern your use of our websites, products and services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
1. Eligibility and accounts
The Services are intended for business use. You must be authorised to enter into these Terms on behalf of your organisation. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
2. Use of the Services
We grant you a limited, non-exclusive, non-transferable right to access and use the Services in accordance with these Terms and any applicable order or agreement. You agree not to:
- Use the Services in any unlawful, harmful or fraudulent manner;
- Copy, modify, reverse-engineer or create derivative works of the Services except as permitted by law;
- Interfere with or disrupt the integrity or performance of the Services;
- Attempt to gain unauthorised access to any systems or data; or
- Use the Services to build a competing product or service.
3. Customer data
You retain all rights to the data you submit to the Services ("Customer Data"). You grant us the rights necessary to process Customer Data to provide and improve the Services, subject to our Privacy Policy and any applicable data-processing agreement. You are responsible for ensuring you have the rights to provide Customer Data to us.
4. AI features
Our Services include features powered by artificial intelligence. AI-generated outputs may contain inaccuracies and should be reviewed before reliance. You are responsible for evaluating the suitability of any output for your intended use. We do not warrant that AI outputs will be error-free or fit for any particular purpose.
5. Fees and payment
Where the Services are provided on a paid basis, you agree to pay the fees set out in the applicable order or agreement. Unless stated otherwise, fees are non-refundable and exclusive of taxes, which are your responsibility.
6. Intellectual property
The Services, including all software, content and trademarks, are owned by travai or its licensors and are protected by intellectual-property laws. Except for the limited rights expressly granted to you, we reserve all rights, title and interest in the Services.
7. Third-party services
The Services may integrate with or link to third-party products and websites. We are not responsible for the content, policies or practices of any third party, and your use of them is at your own risk.
8. Confidentiality
Each party agrees to protect the other's confidential information and to use it only as necessary to perform under these Terms.
9. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.
10. Limitation of liability
To the maximum extent permitted by law, travai will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from your use of the Services. Our total liability under these Terms will not exceed the amounts paid by you for the Services in the twelve months preceding the claim.
11. Termination
We may suspend or terminate your access to the Services if you breach these Terms or if we are required to do so by law. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination will continue to apply.
12. Changes to these Terms
We may update these Terms from time to time. We will post the revised version on this page and update the "last updated" date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which travai is established, without regard to conflict-of-law principles. The courts of that jurisdiction will have exclusive jurisdiction over any disputes, except where applicable law provides otherwise.
